MONROVIA, LIBERIA – Justice Yamie Quiqui Gberisay of the Supreme Court has ruled that Criminal Court “C” Resident Judge A. Blamo Dixon must step aside from presiding over the economic sabotage trial involving former Finance Minister Samuel Tweah and others. The decision, handed down on January 24, 2025, came after a petition was filed by state lawyers citing allegations of bias and partiality against Judge Dixon.
In his ruling, Justice Gberisay stressed the critical importance of impartiality in judicial proceedings, noting that fairness and neutrality are fundamental to ensuring justice. He stated that the appearance of bias, whether real or perceived, has the potential to erode public confidence in the judiciary and compromise the integrity of the trial.
The prosecution argued that Judge Dixon’s handling of the case had raised concerns about his objectivity. They referenced specific incidents, including comments made by the judge regarding the detention of co-defendant Samuel Tweah at the Monrovia Central Prison. Prosecution lawyers claimed that the judge’s remarks suggested a prejudgment of the matter, which they viewed as prejudicial to their case.
Defense lawyers opposed the petition for recusal, arguing that the claims of bias were unfounded and lacked legal merit. They maintained that recusal should only be considered in cases where there is clear evidence of a conflict of interest, familial ties, or other established grounds recognized by law. However, their arguments failed to convince Justice Gberisay, who determined that the allegations warranted the judge’s removal to ensure a fair trial.
Justice Gberisay highlighted the broader implications of the case, stating that the judiciary must remain above reproach in order to uphold its role as a guardian of justice. He noted that even the perception of favoritism or prejudice could damage the credibility of the courts and diminish public trust in the legal system.
The prosecution’s efforts to remove Judge Dixon began in December 2024, when they filed a motion seeking his recusal. That motion alleged a pattern of conduct that undermined the judge’s impartiality. After Judge Dixon declined to step down, a second petition for a writ of certiorari was filed later that month, prompting the Supreme Court’s intervention.
In his ruling, Justice Gberisay emphasised the need for judicial officers to maintain the highest standards of integrity and neutrality, particularly in cases involving high-profile individuals and allegations of significant financial misconduct. He emphasized that preserving the sanctity of the court is essential to ensuring justice is served.
