MONROVIA – The Supreme Court of Liberia has delivered a decisive ruling affirming the Modern Development and Management Corporation (MDMC) as the exclusive entity responsible for issuing drivers’ licenses and vehicle documents. The judgment, handed down on February 17, 2025, puts an end to a prolonged legal dispute, reinforcing MDMC’s contractual authority under the Ministry of Transport.
Presiding over the case, Justice Yamie Quiqui Gbissay ruled that MDMC’s operations fall strictly within the Ministry of Transport’s legal domain. The decision invalidates any claims by the Ministry of Justice to exert control over the issuance of transportation documents, emphasizing that the Ministry of Transport alone has the statutory mandate to oversee such affairs.
The controversy erupted when the Ministry of Justice attempted to assume oversight of Liberia Traffic Management (LTM) operations, citing concerns over document security. However, the Supreme Court determined that the Ministry of Justice lacked legal grounds for such involvement. Justice Gbissay referenced the 1987 law governing the Ministry of Transport, stating that its authority over transportation matters, including licensing and registration, remains unchanged.
As part of the ruling, the court ordered an immediate halt to any unauthorized activities by LTM that infringe upon the Ministry of Transport’s jurisdiction. Any efforts to override MDMC’s role, particularly under directives from the Ministry of Justice, were deemed unlawful and prohibited going forward. The verdict ensures that MDMC will continue issuing transportation documents without interference.
The ruling provides a major boost to the Ministry of Transport and MDMC, bringing long-awaited clarity to a sector that has faced uncertainty due to conflicting claims. With this legal affirmation, the issuance of vehicle-related documents is expected to proceed without bureaucratic hurdles, benefiting both the government and the public.
In response, the Ministry of Transport welcomed the Supreme Court’s decision, hailing it as a reaffirmation of its authority. “This ruling upholds the integrity of the transportation system and ensures that proper legal structures are maintained,” stated the Minister of Transport. “We remain committed to working with MDMC to deliver efficient services to the public.”
MDMC also expressed satisfaction, emphasizing its dedication to maintaining a secure and transparent documentation process. “The Supreme Court has confirmed our rightful role,” said the MDMC CEO. “We will continue to fulfill our mandate in close coordination with the Ministry of Transport.”
The Ministry of Justice, which had sought to expand its authority over transportation documentation, has yet to release an official statement. With the Supreme Court’s verdict now settled, its efforts to challenge MDMC’s control have been effectively shut down.
