Who is telling the truth. Judge Mappy Morgan says that she had a phone conversation with lawyers representing Amos Brosius before she lifted the freeze on Brosisu account. Brosius lawyers say they were never contacted and neither was Brosius informed that Cllr. Negbalee Warner had written a letter to the Court requesting lifting of the freeze on Brosius’ account.
On July 24, 2013, Cllr. Negbalee Warner wrote the letter. On July 25, 2013, Judge Mappy Morgan not only lifted the freeze but instructed LBDI President John Davies to pay US$212,000 to the Bailiff of the Commercial Court which was delivered to the Court.
Judge Mappy’s colleagues wrote a dissenting opinion against her action but Chief Injustice Francis Korkpor ignored it. Up till now, nobody can explain what happened to the money, not even Judge Mappy Morgan nor Chief Injustice Korkpor.
The Judicial Inquiry Committee looked into the matter and determined that Judge Mappy Morgan had acted unethically and even recommended withholding her salaries and benefits for a period of time.
Associate Justice Yuoh voted in favor of action against Judge Mappy Morgan. Now I have learned that since becoming Chief Justice she has upturned her decision.
There are suggestions that judge Mappy Morgan is related to President George Weah and could be the reason why she was let off the hook by Chief Injustice and Yes Man Francis Saye Korkpor.
The question is are phone calls(not text) permissible to stand as evidence in court? What is the use of the Judicial Inquiry Committee if its decisions cannot be respected?
Is this the kind of dispensation of justice that the nation is going to bear witness to? It is indeed a sad day for Justice in Liberia. But one day to come questions will be asked and investigations and probes will be launched.
The Liberian people will then get to know the truth. Chief Injustice Korkpor must explain or give an account of what happened to Brosius’s money. Is this the kind of justice we should expect to see in 2023 when election disputes are certain to arise?
This is analogous to and indistinguishable from daylight highway robbery. Judge Mappy Morgan and Chief Injustice Francis Saye Korkpor must account for the money illegally withdrawn from Brosius’s account after the Bailiff turned the US$212,000 to Judge Mappy Morgan.
Truly a sad day for Justice in Liberia and perhaps even more sad days to come for Justice in Liberia.
